By submitting any content to FlatCheck, including ratings, reviews, and photographs ("User Content"), you grant TARA Ratings a non-exclusive, royalty-free, sublicensable, worldwide, perpetual licence to use, reproduce, modify, adapt, analyse, and display such User Content for any purpose related to the operation and improvement of our services. You retain ownership of your User Content.
You represent and warrant that: (a) any User Content you submit does not infringe the intellectual property rights, privacy rights, or other rights of any third party; (b) you have all necessary rights to grant the licence above; and (c) your use of the platform complies with all applicable laws.
All content on FlatCheck, including TARA Ratings, Fit Score results, and AI-generated assessments, is provided for general informational purposes only and constitutes the opinion of TARA Ratings' AI systems. It does not constitute financial, legal, surveying, valuation, or other professional advice. TARA Ratings makes no warranty as to the accuracy, completeness, or reliability of any content. You should obtain independent professional advice before making any property-related decision. To the maximum extent permitted by law, TARA Ratings shall not be liable for any loss or damage arising from your use of, or reliance on, any content on the platform.
You agree to indemnify and hold harmless TARA Ratings, its officers, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms, your User Content, or your misuse of the platform.
We reserve the right to remove, edit, or disable access to any User Content at any time, without prior notice, for any reason or no reason.
In the event of any dispute arising out of or in connection with these Terms or the use of FlatCheck, you agree to first attempt to resolve the dispute through good-faith negotiation by contacting us at privacy@tararatings.com. If the dispute is not resolved within sixty (60) days, either party may refer the dispute to mediation administered by the Hong Kong Mediation Centre (or such other mediation body as the parties may agree). Nothing in this section shall prevent either party from seeking interim or injunctive relief from a court of competent jurisdiction, or limit your right to lodge a complaint with the Office of the Privacy Commissioner for Personal Data.
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. In the event of any inconsistency between the English and Chinese versions, the English version shall prevail.
